Spanish judge issues arrest warrant for 3 GI's

Don't know if you remember the details of this incident, but it was pretty controversial at the time in the international press.

A judge has issued an international arrest warrant for three U.S. soldiers whose tank fired on a Baghdad hotel during the Iraq war, killing a Spanish journalist and one other, a court official said Wednesday. ......

The Spanish judge said he issued the arrest order because of a lack of judicial cooperation from the United States regarding the case.

  • I didn't know about this. Don't we have an extradition treaty with Spain? Are there exemptions for active duty military? Nice blog!

  • Yes, we have extradition treaties with Spain, but I think this might fall under that strange regimen of bilateral deals the US has signed in lieu of joining the ICC(International Criminal Court.)

    Remember all that, where we were signing those individual deals with countries which said that roughly, if they can face investigation in the US for crimes they will, and technically, they have faced investigation in the US.

    I don't know if we actually have one of these deals with Spain, but I would guess that we do.

    The main thing I remember was that in the background of the ICC spat, that the Bush critics were saying that these deals were intended to bypass the ICC so Sr. commanders could not be tried for war crimes.
